Who We Are

   The New York State Foreclosure Defense Bar ("NYSFDB") is a membership, New York, not-for-profit corporation,  founded in 2011 by a group of attorneys practicing in the area of foreclosure defense and loss mitigation.

 

   NYSFDB's purpose is to develop and implement foreclosure defense jurisprudence and legal practices that protect property owners in accordance with the intent, letter and spirit of the New York State Constitution and laws. NYSFDB's core values are guided by and grounded in the due process clause set forth in Article I, Section 6 of the New York State Constitution.  

 

   The overall concern of homeowners, legislators and the community at large is that a significant percentage of working families, especially families of color, will be divested of properties and displaced from their communities without due process of law, in spite of the protections of CPLR 3408 and the statutorty directives of New York State Legislature in 2006, 2008 and 2009.  

     In 2016, NYSFDB has called for additional action by the New York State Legislature, on an emergency basis, in light of recent developments in the courts, to save homeownership (that is, to advance the Legislature's intent).  In so doing, NYSFDB has sounded an alarm for additional regulatory and governmental oversight, for improvement in the court’s administration of settlement conferences, for eradication of the influence of Fannie Mae, Freddie Mac and other private-equity and cash-rich  investors on state courts,  for preservation of  the due process protections afforded to New York homeowners,  for continued  attention to the fact that  New York state is a judicial foreclosure state, and for funding of the legislative mandate  for representation of all pro se homeowners.
